Woman Claims Losing Her Legs Is the Hospital's Fault

The NY daily News reported on a medical malpractice case currently on trial in Brooklyn Supreme Court. Stacey Galette, 33, nearly died in 2009 after suffering blood poisoning and gangrene, which she claims happened when a laparoscopic surgeon at the Winthrop University Hospital punctured her colon while attempting to remove an ectopic pregnancy.

She was admitted to the ICU for 73 days after the procedure, and during that time experienced three cardiac arrest events, received a colostomy, underwent skin grafts and sustained permanent hearing loss. Perhaps the most severe side effect of this botched surgical attempt was loss of both legs below the knee.

Shockingly, the Long Island hospital claims that the only reason she is alive today is because of the skill and care of their doctors. The woman has filed a lawsuit against the hospital claiming multiple millions of dollars in damages.

The case will be decided by jury verdict. If the jury rules that the hospital's negligence caused Ms. Galette to sustain those serious injuries and almost lose her life, then they will be responsible for deciding the exact monetary amount she is entitled to.

According to the plaintiff, if it were not for the unintentional five millimeter hole the doctors created in her colon, she would not have sustained the injuries that she did from a routine laparoscopic procedure. She states in her complaint that despite her complaints of symptoms like severe pain, fever and abnormal heart rate post-procedure, the doctors did not listen to her and take action to treat her condition.

Medical malpractice lawsuits arise out of negligence or carelessness on behalf of doctors or other healthcare professionals that leads to patient injury or increased illness. For a medical malpractice lawsuit to be valid, the plaintiff's attorney must establish the following four elements:

  1. Doctor owed patient a professional duty
  2. Doctor breached that duty owed
  3. As a result of that breach, the patient was injured
  4. Injuries can be proven
