New York State Labor Law § 240 explains that all employers are required to provide their employees with a reasonably safe work environment. Specifically, construction-industry employers must provide their workers with proper scaffolding, harnesses, safety gear, hoists and other equipment needed to maintain a safe construction site.

New York labor law is unique in that it is one of the last states that does not allow much room for liability to be shifted onto construction workers and subcontractors, specifically in elevation-related accidents like falls from scaffolding. Scaffolding: A Leading Cause Fall Injuries
